NCCER is one of the curriculums we use at Build Smart Institute. For all virtual exams there is a $3 fee for retesting. Build Smart Institute will cover the initial testing fee, however you will be responsible for all retakes. trainees may retake exams every other day for up to 3 years after your first exam. By signing, I agree that I will pay all retesting fees invoiced by BSI.

Some Build Smart Institute Courses or Programs will require the use of power tools, power equipment, hand tools and potentially hazardous materials, equipment and processes. Trainee will be instructed in the proper use and handling of equipment and materials. Trainee will not be permitted to operate the equipment or work in the shop portion of the facility until they can demonstrate safe use of such. If your Course or Program includes instruction and quizzes related to safety rules, you must earn a 70% pass rate for the safety exam and 100% pass rate fore Performance of the Safety Procedures. A trainee with absences during the safety portions of the class or who requires multiple re-tests may not be able to participate in certain portions of the hands-on learning and may be required to make special arrangements to complete the necessary work.

Proper clothing for a shop environment is required. Clothing must not be loose fitting and proper full foot coverage must be worn while working in the shop. The BSI Shop / Lab space will be considered a work environment, not a fashion show. Trainees will be required to wear z87.1 eye protection, safety vests and hardhats in the shop at all times. Additional Personal Protective Equipment (PPE) will be required from time to time. Failure to dress appropriately, refusal to wear PPE or not abide by the BSI Safety Program or Rules will result in an alternative written assignment and reduced or no participation credit for the hands-on portion of the instruction.

You must also have the proper attitude due to the dangerous and serious nature of the shop. Immature actions, disregard for safety instructions and failure to do as instructed will not be tolerated and may result in expulsion from the BSI Program(s) without tuition refund.

Personal Protective Equipment (PPE) will be provided for the Core Fundamentals of Construction Class only. If trainee loses PPE or wishes to use BSI PPE, they may purchase the individual item from Build Smart Institute.

I understand that some of the instruction and work that I will participate in at Build Smart Institute can present Danger and Hazards that could result in injury, serious injury or death and I assume all risk and hazards incidental to the conduct of the activities, and release, absolve and hold harmless Build Smart Institute and all its respective officers, agents, instructors, administrators and representatives from any and all liability for injuries to said child arising out of traveling to, participating in, or returning from Build Smart Institute.

In case of injury, I hereby waive all claims against Build Smart Institute including all instructors and affiliates, all participants, sponsoring agencies, advertisers, and, if applicable, owners and lessors of premises used to conduct the event. There is a risk of being injured that is inherent in all construction, shop and construction lab activities. Some of these injuries include, but are not limited to, the risk of cuts, splinters, bruises, fractures, paralysis, or death.

ACKNOWLEDGEMENT:
I have read and understand the shop requirements as outlined in the aforementioned shop policies, and I am aware that I am expected to follow instructions and all Safety Programs and rules.

I agree to abide by all of the BSI Safety Rules, Programs and behavior standards as presented by the instructor in the use of the resources in the shop laboratory.

Build Smart Institute may record my image and voice on video and take photographs as I participate in Session, Program or Semester activities conducted at Build Smart Institute or at BSI event locations, by the Instructors, Administrators, Officers, Directors and Staff, and to use copies of such recordings and photographs in Build Smart Institute documentation, promotions, marketing, reference materials, instructional materials, written commentary, essays, classroom plans, assignments, etc.

I also give Build Smart Institute and the Staff permission to use copies of materials that I have produced or may produce as part of class activities, all on the terms and conditions described here:

• My last name will not appear on or in any recordings, photographs or school works that are submitted or captured.
• The Build Smart Institute may use the materials that are submitted or captured for the purposes as described above.
• The Build Smart Institute may disclose or distribute copies of the materials which are recorded, imaged or otherwise submitted by the trainee to its marketing resources, partners as well as data collection and instructional resources or publications in which such materials might be included.
• By providing permission, you will also be granting the Build Smart Institute a perpetual, irrevocable and royalty-free license to use any of the materials described above without compensation

1. If a device is assigned to a trainee, it is only to be used during class.
2. Trainee will not change the settings or background on any device.
3. Trainee will not use the device unsupervised.
4. Trainees will not use the device to check personal email or any social networking site, unless it is class related.
5. Trainee will not save any work on the device’s hard drive or the Build Smart Institute Server, unless otherwise instructed by the staff of Build Smart Institute.
6 YouTube, Pandora, games, and similar sites are NOT ALLOWED unless it is being used for class. Trainee will NOT use devices for play.
7. Trainee will not to deface, vandalize, or otherwise destroy/harm the devices in any way.
8. Trainee will not download anything onto the device without Build Smart Institute staff approval.
9. Trainee will not attempt to bypass any security features

Confidential Information and Intellectual Property Agreement
• Build Smart Institute is engaged in the business of providing Educational Services, namely, classes and facilities, for middle school, high school, adult learners and college level trainees in the fields of residential and commercial construction.
• The success of Build Smart Institute depends in part on maintaining confidential and licensed materials, instruction and information relating to the programs of The Build Smart Institute to which Parents, Guardians, Trainees or Participants are being given access in reliance on this agreement.
• Based on the decision to grant an instructional access relationship with the Parents, Guardians, Trainees or Participants, the parties agree as follows:

1. Program Information
Program Definition. As used in this Agreement, “Program Information” shall include, but not be limited to, the following:
a. books, instruction materials, online portals, online courses and electronic files relating to the operation of Build Smart Institute, including website operation
b. trainee or staff names, addresses and other contact information
c. curriculum and products of BSI
d. trainee requirements
e. terms and conditions of trainee agreements
f. pending BSI programs
g. any and all BSI, HBI, NCCER, DOLI or other curriculum materials and
h. to the extent not already covered by (a) through (g), any programs of Build Smart Institute.
i. Program Information shall not include information that is available to the public through reasonable and lawful means and that did not become available to the public through any unlawful conduct or breach of any agreement by Parents, Guardians, Trainees or Participants or any other person.

2. Non Disclosure
Parents, Guardians, Trainees or Participants shall not, either during their BSI Program relationship or at any time after such program relationship is completed, disclose, divulge or communicate to any person or other entity, or use for consultant’s own benefit, any Program Information of Build Smart Institute.

3. Program Information
Program Information and all other business information or documents, are solely and exclusively the property of Build Smart Institute.
• Parents, Guardians, Trainees or Participants shall not remove from the Build Smart Institute Facility Program Information or any other documents or data relating to the Programs of Build Smart Institute, unless authorized by Build Smart Institute and required for trainee to perform trainee’s Program for Build Smart Institute. Upon the completion of the Program relationship or upon request of Build Smart Institute, Parents, Guardians, Trainees or Participants shall promptly deliver to Build Smart Institute all documents, files and other items (whether maintained in electronic or hard copy format) obtained or generated in the course of trainee’s Program with-out retaining any copies, notes, or excerpts thereof, unless authorized by Build Smart Institute. Any social media contacts, including “followers” or “friends” that are acquired through accounts (including but not limited to email addresses, blogs, Twitter, Facebook, YouTube or other social media networks) used or created on behalf of Build Smart Institute are the property of Build Smart Institute.

COOPERATION: I will cooperate fully in the programs put forth by Build Smart Institute (BSI), attend any parent meetings, and correspond quickly to requests from Build Smart Institute.

INTERNET ACCESS: Trainees will need access to the internet for a variety of instructional materials.

DISSATISFACTION: If I become dissatisfied with the school in any respect, I will seek to resolve the matter with the person or persons involved, rather than begin to spread criticism, listen to criticism, or hold a negative attitude. I pledge that, if for any reason, my child does not respond favorably to the school, I will not try to change the school to fit the trainee’s needs, but will withdraw trainee quietly and without delay and without receiving refund of tuition.

ACHIEVEMENTS: Enrollment in the Build Smart Programs does not guarantee competency achievements, badges, credentials, certificates or endorsements from Build Smart Institute.

GRADING: Trainee must have a 70% correct score in order to pass the knowledge quizzes. Instructors will designate a pass or fail on each hands-on skills test or review. All grading, competencies and certifications will be tracked on the electronic BSI Learning Portal.

DISHONESTY: Academic dishonesty, also known as cheating, plagiarism, copying, transfer of computer files, etc., is using work that is not your own and may result in immediate expulsion from BSI, with no refund of tuition.

RESPECT: The trainee will show respect for those in authority over them, even if the trainee disagrees with the authority.

ATTENDANCE: Trainees are expected to attend each class session. If they do not, trainees risk not completing the course, accreditation, certification, badges or competency achievement. Make up work will be considered on a case by case basis. Parents, Guardians must inform BSI, prior to start of an individual class session, if the trainee will be absent.

PICK UP: Trainees under 18 will not be allowed to leave the BSI building until an authorized party or parent/guardian arrives at the school to pick them up.

VISITORS: Parents, guardians, and other visitors will NOT be allowed to attend BSI with the trainees without written permission from BSI. The phone numbers provided in the Trainee Application will be used for notifications.

ELECTRONIC DEVICES such as cellular phones, radios, CD & MP3 players, ear buds, headphones, beepers, laser lights and pager-type devices are not to be operated while class is in session unless the trainee is given specific permission to do so.

PERSONAL PROPERTY: Trainees assume sole responsibility for loss or damage to any personal property, such as garments, tools and equipment, or electronic equipment. BSI is not responsible for any lost, stolen or missing items. Large sums of money or jewelry of either real or “keepsake” value should not be brought to BSI. Trainees assume responsibility for loss or intentional damage to all school issued tools and equipment and all school owned projects. Intentional damage to school property is considered vandalism and will result in immediate expulsion from BSI, without tuition refund and will be responsible for the cost of the replacement or repair of the tool(s) or equipment.

DRESS CODE: In order to promote a positive and safe learning environment, all trainees need to follow these guidelines:

•Trainees may not wear clothing with writing, slogans, pictures, or symbols that depict alcohol, tobacco, or drugs(or their manufacturers).

•Trainees may not wear clothing with writing, slogans, pictures, or symbols that depict obscenities, vulgarity, racism, sex, sexual innuendo, violence, or gang affiliation.

•Trainees may not wear immodest clothing, which includes clothing that exposes undergarments or inappropriately exposes the body. Skirts and shorts must reach mid-thigh length. (Examples of clothing items that should not be worn include, but are not limited to: spaghetti strap tops; tube tops; halter tops; midriff tops; backless tops; “muscle” tops).

•Trainees must wear sturdy footwear with sturdy soles and must have a closed toe and heel. Sandals cannot be worn due to safety concerns. Work boots are preferred.

(Any trainee violating this policy will not be allowed to attend class sessions.)


DRUGS, ALCOHOL & TABACCO USE: BSI is a drug, alcohol, and tobacco free zone and any use of such within the BSI property is prohibited. Prohibited products include electronic cigarettes, vaporizers, and drug paraphernalia. Trainees in violation of this policy will be immediately expelled with no tuition refund.

WEAPONS OR DANGEROUS INSTRUMENTS: Trainees may not carry or bring in any firearm, knives, explosives, any dangerous or deadly weapon or destructive device onto the BSI premises, facilities, or during any BSI related event or outing. Any trainee in possession of such weapons or dangerous instruments while at BSI or related BSI events or activities will be recommended for expulsion.

BULLYING: Bullying is defined by any aggressive or unwanted behavior that is intended to harm, humiliate or intimidate another person. Trainees shall not threaten, intimidate, make gestures, call names, hurl insults, write notes, or incite or instigate any activity that could cause physical or mental injury to other trainees or staff members. Bullying does not include typical teasing, horseplay, or peer conflict.

DISRUPTIVE BEHAVIOR: Any disorderly conduct that interferes with instruction or related activities is prohibited. Examples of disruptive behavior, though not exhaustive, includes fighting, cursing, harassing other trainees or teachers, obscene gestures, rudeness, making unnecessary noise, or threats against the school or personnel.

DAMAGE OR DESTRUCTION OR PROPERTY: Trainees shall not attempt to cause damage or destroy any school property or property belonging to others. Though the following list is not exhaustive, this policy pertains to the interior and exterior of the BSI facilities, books, computers, software, private automobiles, tools, equipment, and software.

TRANSPORTATION: Build Smart Institute transportation is reviewed on a per trainee/class basis and is not guaranteed available. Build Smart Institute will begin oversight and instruction of the trainee once the trainee is registered inside the Build Smart Institute at the beginning of class session through when the trainee is properly signed out of the Build Smart Institute. Build Smart Institute assumes no responsibility for activities or actions in the Build Smart Institute Parking lot unless it is part of a supervised instructional activity.

NOTIFICATION: Parents, guardians and trainees will be notified via call or text, if classes are cancelled due to weather or for any other reason.
